Benefits Information
Medical and Dental Plan
Derive Technologies provides all full-time employees with medical and dental coverage, which begins on the first day of the month following the completion of a ninety (90) day introductory employment period. Derive pays a portion of the premiums. Employee medical and dental contributions are deducted on a pre-tax basis.
401(k) Plan
Derive offers all employees age 21 or older with the opportunity to invest in their retirement through a 401(k) savings plan. Employees may contribute up to 15% of their salary through payroll deductions up to the annual maximum set by the federal government. Contributions may begin after the completion of three months of service.
Vacation Benefits
All full-time and part-time employees are eligible to earn paid vacation time based on time of service after the first year of service. Part-time employees earn pro-rated vacation based on the average hours per week worked during the previous six-month period.
After the first year of service, vacation days are earned at the rate of 1/2 day for each complete month of service up to a maximum of five (5) vacation days. After two years, employees earn vacation at the rate of one day for each complete month of service up to a maximum of ten (10) days per calendar year. Beginning with the calendar year in which the employee celebrates their 5th anniversary (your 6th calendar year), vacation is earned at the rate of 1.5 days per complete month of service up to a maximum of fifteen (15) vacation days per calendar year.
Derive employees who do not take all earned vacation time by the end of a year may carry over a maximum of one week of accrued vacation time.
Paid Holidays and Leave
Derive offers six (6) paid holidays and one additional "floating holiday" per year. In addition, we provide six (6) paid sick/personal days per calendar year to all employees for periods of temporary absence. All full-time and part-time employees who have completed their 90-day introductory period are eligible for these benefits. Note that temporary employees are not eligible to be paid for sick/personal days, and sick/personal days cannot be carried over to the next year by any employee.
Military Leave
Employees who are required to serve in any branch of the Armed Forces of the United States or are engaged in state military service will be given the necessary time off without pay. Accrued vacation or sick/personal time may be used for this leave if the employee chooses.
In the case of military leave in excess of two (2) weeks, Derive will follow all current government regulations in regard to restoration of position and pay.
Family and Medical Leave
The Family Medical Leave Act, "FMLA", requires specified employers to provide up to twelve (12) weeks of unpaid, job-protected leave to "eligible" employees for certain family and medical reasons. Employees are eligible if they have worked for a covered employer for at least one year and for 1,250 hours over the previous twelve months, and if there are at least 50 employees within a 75 mile radius.
Unpaid leave must be granted for any of the following reasons:
- To care for the employee's child after birth or placement for adoption or foster care.
- To care for the employee's spouse, child or parent who has a serious health condition or for a serious health condition that makes the employee unable to perform the employee's job
At the employee's option, or Derive's option, certain types of paid leave may be substituted for unpaid leave. (i.e. accumulated sick/personal days, vacation days)
The employee's health coverage under any group health plan shall be maintained for the duration of the FMLA leave. Upon the employee's return to work, the employee must be restored to their original or equivalent position with equivalent pay, benefits, and other employment terms.
Short Term Disability
In accordance with schedules established by New York State law, all employees who have completed at least four (4) consecutive weeks of work are eligible for disability insurance benefits while the employee is not at work due to illness or disability. Benefits are paid from the eighth day of absence and may continue for up to twenty-six (26) weeks for any individual disability or illness. Benefits are paid to the employee only when that employee is not otherwise receiving a salary or sick pay due to an illness or disability not covered under Workers Compensation.
Maternity Leave
As described in the Short Term disability section, Derive Technologies has short-term disability insurance, which will cover an eligible employee for disability, including maternity leave.
Bereavement Leave
Derive Technologies understands that, in the event of a death in an employee's family, time off may be needed. Compensation will be provided for three days in the event of the death of a family member. For this purpose, family members are defined as the employee's spouse, children, parents, mother-in-law, father-in-law, sister, brother, grandchild or grandparent.
